Welcome to EsteMarie Event Management.
These Terms & Conditions (“Terms”) govern your use of the EsteMarie Event Management website, including information, inquiry forms, scheduling features, online payments, and other services made available through the website.
Throughout these Terms, “EsteMarie,” “we,” “us,” and “our” refer to EsteMarie Event Management.
By accessing or using this website, submitting an inquiry, scheduling a consultation, or making an online payment, you acknowledge and agree to these Terms.
Clients who hire EsteMarie will receive a separate written service agreement governing the specific services provided for their celebration. If there is a conflict between these website Terms and a signed client service agreement regarding contracted services, the signed service agreement will control.
We make reasonable efforts to ensure the information provided on our website is accurate, current, and helpful.
Website content is provided for general informational purposes and may be modified, updated, or removed at any time.
Information displayed on this website does not constitute a binding proposal, contract, guarantee of availability, or guarantee of final pricing.
Submitting an inquiry, requesting information, scheduling an initial conversation, or receiving a proposal does not automatically reserve your event date or guarantee EsteMarie’s availability.
Your date and services are considered reserved only after all applicable booking requirements have been completed. Depending on the service, these requirements may include:
Until these requirements are completed, dates and services remain subject to availability.
Prices displayed on our website are starting investments unless specifically stated otherwise.
No two celebrations require exactly the same amount of work. Final pricing may be affected by guest count, venue, event duration, number of vendors, multiple locations, travel, staffing, design complexity, setup requirements, cultural or ceremonial traditions, formal program elements, photography schedules, entertainment, timeline complexity, and additional services.
We don’t price your celebration based solely on what it’s called. We price it based on what it takes to do it well.
Your customized proposal will identify the professional services and pricing applicable to your celebration.
Proposals are based on the information available to EsteMarie at the time they are prepared.
If the scope of a celebration changes significantly after a proposal or agreement has been prepared—including changes to guest count, venue, locations, event duration, services, design requirements, staffing, logistics, setup requirements, or additional events—the services and associated fees may need to be adjusted.
We will communicate applicable changes before additional services are performed or charges are incurred whenever reasonably possible.
No surprise services. No surprise invoices.
A non-refundable retainer or reservation fee may be required to reserve EsteMarie’s services and your event date.
Your event date is not considered reserved until EsteMarie has received all required booking materials, including the signed service agreement and required retainer when applicable.
The retainer compensates EsteMarie for reserving professional availability, beginning administrative and preparatory work, and potentially declining other business for the applicable date or service period.
Retainers and reservation fees are non-refundable except where otherwise required by applicable law or expressly provided in your signed service agreement.
Payment requirements vary depending on the services selected, total investment, and amount of time remaining before the celebration.
Your proposal, invoice, or service agreement will identify applicable:
Payments must be made according to the schedule established for your services.
Failure to make required payments may result in suspension of services or other remedies as described in your service agreement.
EsteMarie accepts online payments for eligible retainers, consultations, invoices, services, and other approved charges.
Available payment methods will be displayed through the applicable invoice or online payment platform.
Online payments may be processed through an independent third-party payment processor. EsteMarie does not necessarily receive or store your complete credit or debit card information.
By submitting an online payment, you authorize the applicable transaction and acknowledge that the payment is subject to these Terms, the applicable invoice, and your signed service agreement when applicable.
Any applicable processing, returned-payment, or other payment-related fees will be disclosed when required.
Because event services involve professional time, preparation, creative work, administrative work, and the reservation of dates during which EsteMarie may decline other business, certain payments are non-refundable.
Unless otherwise stated in your signed service agreement:
Retainers and reservation fees are non-refundable.
Consultation fees are non-refundable once the consultation has been provided or the applicable cancellation period has passed.
Fees for services already performed are non-refundable.
Payments made toward future contracted services will be handled according to the cancellation and refund provisions contained in the applicable signed service agreement and applicable law.
Third-party purchases, custom products, rentals, printing, florals, décor, fabrication, vendor deposits, delivery charges, or other expenses purchased, ordered, reserved, or committed on behalf of a client may also be non-refundable according to the applicable vendor’s policies.
We understand that plans sometimes change.
Specific cancellation, postponement, and rescheduling terms for booked celebrations will be contained in the client’s service agreement.
Because EsteMarie reserves dates and professional resources based on confirmed bookings, cancellation or rescheduling may result in the loss of a retainer or other payments as provided in the applicable service agreement.
Requesting a new event date does not guarantee EsteMarie’s availability for that date.
À la carte services may be added to an existing EsteMarie service or, when available, booked independently.
Prices displayed online are starting investments based on typical service requirements. Additional time, staffing, travel, materials, complexity, or expanded scope may result in additional charges.
An à la carte service is not considered confirmed until EsteMarie has accepted the request and any applicable agreement and payment requirements have been completed.
EsteMarie’s Design & Styling fees compensate us for our professional creative services and do not automatically include physical products or third-party expenses.
Unless specifically included in your proposal, items such as florals, linens, furniture, rentals, décor, signage, stationery, printing, lighting, backdrops, custom fabrication, specialty installations, delivery, and outside labor are separate expenses.
EsteMarie will not intentionally make purchases or financial commitments on a client’s behalf without the approval required under the applicable service agreement.
EsteMarie may recommend, communicate with, or coordinate services involving venues, caterers, photographers, videographers, florists, rental companies, entertainers, transportation providers, and other independent businesses.
Unless expressly stated otherwise, these businesses are independent third parties and are not employees, partners, or agents of EsteMarie.
While we strive to recommend reputable professionals, we cannot guarantee the performance, availability, pricing, products, services, conduct, or business practices of independent vendors.
Contracts entered into directly between a client and a third-party vendor remain agreements between those parties.
Successful celebrations require collaboration.
Clients are responsible for providing accurate and timely information, reviewing applicable documents and recommendations, communicating significant changes, making necessary decisions, obtaining required permissions or approvals, and meeting contractual and payment deadlines.
EsteMarie is not responsible for delays, additional costs, or limitations resulting from incomplete, inaccurate, or untimely information provided by a client or other parties outside our reasonable control.
Celebrations may be affected by circumstances that neither the client nor EsteMarie can reasonably prevent.
These may include severe weather, natural disasters, emergencies, illness, venue restrictions or closures, vendor cancellations, transportation disruptions, utility failures, government actions, public emergencies, or other circumstances beyond reasonable control.
Specific rights and responsibilities regarding postponement, cancellation, force majeure, or similar circumstances affecting contracted services will be governed by the applicable service agreement and applicable law.
EsteMarie may photograph or record portions of celebrations we plan, design, coordinate, style, set up, or otherwise support for purposes that may include documenting our work, maintaining our portfolio, and creating business or marketing content.
Content may include photographs or video of:
Subject to applicable permissions and agreements, such content may be used on EsteMarie’s website, social media accounts, online portfolio, digital or printed marketing materials, advertising, presentations, and other business-related promotional materials.
We recognize the difference between showcasing our professional work and publicly sharing identifiable photographs of the people attending a celebration.
Photographs or video captured at an event may incidentally include clients, family members, wedding parties, guests, vendors, or other event participants.
Use of identifiable client imagery for EsteMarie’s promotional or marketing purposes will be subject to applicable permissions, releases, service-agreement terms, and legal requirements.
Clients who prefer that their celebration remain private or who want limitations placed on the types of photographs or video that EsteMarie may publicly share should communicate those preferences before the event.
Specific photography, videography, and social-media permissions may also be addressed in the client’s individual service agreement.
Choosing privacy will not affect the level of care or service you receive from EsteMarie.
Many celebrations include children and teenagers, and we recognize the importance of protecting their privacy.
EsteMarie will use reasonable care when selecting images containing identifiable minors for public marketing or social-media purposes and will comply with applicable permissions, restrictions, and legal requirements.
When a minor is a primary participant in a celebration, such as a quinceañera, Sweet 16, birthday, graduation, or other milestone celebration, appropriate permission from a parent or legal guardian may be required before EsteMarie intentionally uses identifiable images of the minor for promotional purposes.
Parents and guardians are encouraged to communicate any specific photography, videography, or social-media concerns before the celebration.
Professional photographs and videos remain subject to the intellectual property and copyright rights of their respective photographers, videographers, or other creators.
EsteMarie does not claim ownership of another professional’s copyrighted work simply because that content was created at an event we planned, designed, coordinated, or supported.
When EsteMarie shares professional imagery, we will make reasonable efforts to obtain appropriate permission or usage rights and provide attribution when required or appropriate.
Photographers, videographers, venues, and other event professionals may maintain their own portfolio, photography, videography, and social-media policies. EsteMarie does not control the independent use of imagery by third-party vendors.
Subject to applicable permissions and agreed-upon restrictions, EsteMarie may share event-related content on social media before, during, or after a celebration.
Content may include behind-the-scenes preparation, décor installation, venue spaces, room reveals, tablescapes, event details, vendor collaborations, and other aspects of our work.
We may identify or tag participating venues and vendors when appropriate.
If a celebration contains information that should remain confidential until a particular date—such as a surprise party, proposal, pregnancy announcement, private event, or unreleased professional photography—the client is responsible for communicating that restriction to EsteMarie in advance.
We will make reasonable efforts to honor agreed-upon posting restrictions.
Clients may voluntarily provide EsteMarie with photographs, videos, reviews, testimonials, or other event-related content.
If content is specifically provided to EsteMarie for reposting, sharing, portfolio use, or promotional purposes, the person providing it represents that they have the authority to provide the content for the intended use.
EsteMarie may request additional authorization when appropriate before using client-provided content for advertising or other promotional purposes.
EsteMarie approaches Celebrations of Life, memorial gatherings, and other sensitive events with additional care and discretion.
We do not intentionally publish identifiable photographs or video of an individual who has passed away without appropriate permission.
When appropriate, EsteMarie may photograph elements of our work, such as floral arrangements, tablescapes, memory displays, signage, décor, or venue setup, while making reasonable efforts to respect the privacy and wishes of the family.
Families may request that content from a Celebration of Life remain private, and EsteMarie will honor agreed-upon restrictions.
We understand that not every celebration belongs on social media.
Clients may request restrictions on EsteMarie’s public use of photographs or video from their celebration.
Depending on the service agreement, available preferences may include allowing full event imagery, allowing only décor and event-detail imagery, or requesting that the event remain private.
Any specific restrictions should be communicated and agreed upon before the celebration.
Unless otherwise stated, EsteMarie’s original website content, branding, written materials, graphics, service descriptions, planning resources, design materials, templates, and other original materials are owned by or licensed to EsteMarie.
They may not be copied, reproduced, republished, distributed, sold, or commercially used without prior written permission.
Planning documents, timelines, mood boards, design concepts, templates, layouts, and other materials created for clients may also be subject to intellectual property protections and the terms contained in the applicable service agreement.
Our website may contain links to third-party websites, vendors, social-media platforms, scheduling services, payment processors, or other outside services.
These links are provided for convenience or informational purposes.
EsteMarie does not control and is not responsible for the availability, content, privacy practices, security, policies, products, or services of third-party websites.
Your interaction with those websites and services is subject to their own terms and policies.
Your use of this website is also subject to our Privacy Policy, which explains how EsteMarie may collect, use, store, and share information obtained through our website and related services.
We make reasonable efforts to maintain an accurate, functional, and useful website. However, we do not guarantee that the website will always be uninterrupted, error-free, completely current, or free from technical problems.
To the fullest extent permitted by applicable law, EsteMarie is not responsible for damages arising solely from the use of, or inability to use, this website.
Limitations relating specifically to contracted event services will be governed by the applicable client service agreement.
EsteMarie may update these Terms & Conditions periodically to reflect changes to our website, services, pricing practices, payment systems, business operations, or applicable requirements.
When changes are made, the “Last Updated” date at the top of this page will be revised.
Your continued use of the website after updated Terms are posted constitutes acceptance of the revised website Terms.
These Terms are governed by the laws of the State of Nevada, without regard to applicable conflict-of-law principles.
Any additional provisions relating to disputes, venue, mediation, arbitration, or contracted event services may be addressed in the applicable client service agreement.
We believe expectations should be clear before we begin working together.
